You and your spouse have to be living separate and apart with intention to end the relationship. Our lawyers can help draft you a separation agreement which is a legal document that outlines the terms of your and your spouse separation.
There are three grounds for divorce in Alberta:
- Separated for at least one year;

Adultery; or

Cruelty;
If one spouse does not want a divorce, there are still options to be able to file for divorce in Alberta. There are two different types of divorces:

Uncontested: both spouses mutually agree to get divorced and the parties can reach an amicable resolution without attending a form of ADR.

Contested: one spouse does not want a divorce and the other spouse does and you are not able to reach an agreement. In this case the parties may need court intervention to help resolve matters in dispute.

The Family Property Act requires that family property be divided fairly and equitably between the spouses. Our lawyers can help with providing more information and advice to your specific circumstance.
Child support is calculated based on the Federal Child Support Guidelines which considers the spouses’ incomes and the number of children.
Spousal support is financial support that is provided to one spouse by the other. Entitlement depends on the length of marriage, financial needs, their incomes and the role each spouse played during the marriage.
We carefully analyze financial documents and business records to identify any deductions, or business expenses that may impact income calculations. Our goal is to ensure support payments reflect the true financial situation, providing a fair and accurate representation of self-employment income.
Digital assets include cryptocurrencies, online businesses, and digital intellectual property. We provide expertise in evaluating and devising these assets fairing and in accordance with the law during a divorce, protecting your financial interest.
Our team can assist in compelling disclosure through various legal channels, ensuring all necessary financial information is obtained. The Court can also compel full financial disclosure by imposing legal penalties if a party does not comply.
